Carnival Cruise Was No Triumph-Short Claim Period
One thing is certain. All of those people who chose to holiday upon the Carnival cruise ship Triumph, stranded in the Gulf of Mexico, will never forget that disaster. I am certain, that although there were no deaths reported, there will be illness generated by days living in raw sewage and peoples lives will be destroyed by their physical and psychological responses to all this. I would not exactly call this vacation a Triumph.
Carnival will no doubt spin this tragedy to its benefit. I already received this 'personal e mail' from Carnival CEO Gerry Cahill seemingly blaming whoever manufactured or repaired the fuel return line for the #6 diesel generator that apparently leaked starting this fire. The blame game is just beginning. Stay tuned.
Whether the problem was a manufacturing defect, a design problem, a maintenance problem may matter less to those making claims here but it does matter still. Carnival has provided the cruise ship and it must provide a safe ship. Its failure to do so renders it responsible for the damages each passenger has suffered. There may be other defendants here as well. It is a bit disconcerting that Mr. Cahill makes no mention of the fact that the Coast Guard investigator attributed the leak to the fuel line touching some hot surface burning a hole through the line.
For those of us considering whether to ever take a Carnival cruise, perhaps we breath easier if the cause was product failure rather than maintenance. If it turns out that Carnival failed to maintain the line or generator or product at issue, it suggests to me that Carnival may have cut corners in keeping up its ship. If the line was contacting a hot surface, that suggests a maintenance failure.
At least the Carnival crew did not abandon ship leaving the passengers to fend for themselves as did the Costa Cruises crew in the Costa Concordia disaster of January 13, 2012 in the Mediterranean.
Keep in mind, your Carnival Ticket may require you to file a claim within a limited time. In the past Carnival tickets specified a short 185 day period within which passengers must make a complete and detailed Carnival claim. Check your tickets for the precise limitations imposed. Thereafter, additional limitations periods apply for filing a complaint with the applicable court. Don't delay if you intend to make such a claim and locate counsel immediately.
